Why not? Yesterday Blizzard released their pre-launch cartoon presenting some diablo lore. You can't really kill a demon. As RoGH wrote: without Diablo it's not... Diablo.

Lore-wise it was destroyed. Game-wise, Diablo doesn't drop it. Blizzard-wise - they wanted Diablo in Diablo 3, so here he is.
